1. Introduction

We welcome visitors to our website and are pleased about the interest of existing and potential customers in our Privacy Policy. The following information shows we are very serious about protecting personal information.

By agreeing to the following Privacy Policy, you give your consent for Europcar to collect, process and use your personal information in compliance with data protection laws and the provisions below.

2. Information Privacy

Europcar Austria, ARAC GmbH, with registered office at Louise-Piëch-Straße 2, 5020 Salzburg and central administration at Brunner Straße 85, A-1230 Vienna, registered in the commercial register of the District Court of Salzburg under FN 51 993k, represented by Managing Director Mag. Inés Kaufmann, BA, (hereinafter “Europcar” and/or “we”) provides information in this Privacy Policy about the policies of the Company with respect to the protection of personal information collected on the Europcar website (hereinafter the “Website”).

We are providing this information so that customers and prospective customers can make an informed decision about whether they want to provide personal information to Europcar that might be requested or collected in connection with a visit to the Website.

3. Responsibility for processing collected personal Information

Europcar is responsible for processing personal information that is collected
on the www.europcar.at website (the Website) only.

4. Collection of personal information

Europcar only has access to the personal information that is voluntarily provided or listed in this Privacy Policy. We note, in this regard, that personal information is requested in connection with registration for certain services offered on the Website. By approving the Privacy Policy, you provide your consent for the personal information provided in the registration form to be processed. If personal information is not provided, the services in question cannot be used.

We also process data that we receive from information from third parties, such as credit agencies. This data can basically be divided into the following data categories:

-    Contact and identification data: surname, first name, gender, address, email address, telephone number, mobile phone number, date / place of birth, identification numbers, nationality, etc.
-    Contract data: purchased products, (financial) services, date of purchase contract, purchase price, special equipment, guarantees, etc.
-    Creditworthiness and bank data: payment history, balance sheets, data from credit agencies, score values, financial circumstances, account details, credit card number, etc.
-    Accounting data: books, inventories, opening balance sheets, annual financial statements including management reports, business letters and accounting documents, etc., books and records, as well as related documents.
-    Vehicle usage data: with vehicle identification (VIN) or vehicle registration number data that are linked to VIN / vehicle registration number.

We collect personal information, in particular, when users of the Website:

-    register as/become Europcar customers,
-    begin an online reservation, even if it is cancelled,
-    register for the Europcar Privilege loyalty programme,
-    subscribe to the Europcar or Europcar Group email newsletter/email
notices (opt-in),
-    take part in a survey, or a contest,
-    contact Europcar using the Europcar website,
-    use our online services,
-    register to receive electronic invoices.

Personal information is also automatically collected during every visit to our Website. We record information about the computers of website users and assign them a cookie (a small text file with a specific name) that contains information not provided by the users. This information is collected automatically in order to make our Website easier to use.

Unless the information is indicated as optional, we require it to provide the services offered on the Website.

If this information is not provided to Europcar, we may not be able to provide all the services related to the information. If we are unable to provide a service due to missing information, Europcar assumes no liability for non-provision or incomplete provision of this service.

The users of the Website are in all cases themselves responsible for the accuracy of the information provided. Europcar reserves the right, without prejudice to other measures that can be initiated under applicable law, to exclude users who have provided false information from receiving services for which they have registered. If third party information is provided, it must be ensured that these third parties have given their prior express consent for the information to be disclosed to Europcar for the processing purposes described above. Europcar must be informed without delay of any changes to personal information, so that the information is up-to-date at all times. Customers and prospective customers hereby undertake in this regard to provide truthful personal information and ensure that all personal information provided to Europcar is up-to-date.

We also process data that we receive from outgoing third parties, such as high-quality credit agencies.


5. Collection of personal information using cookies And other internet technologies

We use cookies and other Internet technologies to simplify and log the use of services offered on this Website. More information on cookies and the personal information we collect using cookies and other Internet technologies is provided in section 6 below “Use of cookies”.

6. Use of cookies

We collect information about the computers of Website users in order to rate the contents of the Website and accesses to the Website. We can use this information to make our Website easier to use by optimising navigation, and to develop programmes and create content that is of interest to our members and visitors to our Website.

The Website uses the following types of cookies:

6.1 Session cookies

These are used to track the navigation of users within the Website during a visit. They are needed for operation of the Website, but are not used for personal identification. Session cookies are temporary, and are automatically deleted when the Website is left.

As you may have noticed, our Website also contains third party advertising. In some cases, these third parties install a cookies on the computers of Website users that we have no influence over.

7. Re-Targeting

Our webpages use so-called re-targeting technologies. We use these technologies to make Internet content more attractive to Website visitors, as this technology allows us to target users who have previously shown an interest in our content and products with advertising on the pages of our partners. We believe that displaying personalised, interest-based advertising is generally more attractive to Internet users than advertising that has no such personal connection. 8. Computer information

Each time a page is accessed during a visit to the Europcar Website, or if only one page is accessed, our Website records certain technical information about the computers of Website users. This information is collected from the computer’s Internet browser and can include information about the IP address, operating system, browser (e.g. Firefox, Opera, Safari, Netscape Navigator, Internet Explorer, etc.), display resolution and the website visited before accessing the Europcar Website (“referrer”). We store this information for a maximum of one year, unless business
requirements make longer storage necessary.

9. Use of AT Internet

Some of our websites and HTML emails include tracking pixels („pixel tags“) that we use to track users of our Website and recipients of our emails. Pixel tags are used to record user page views, visits, navigation data and duration of visit to our Website. This information can be used, for example, to determine popular destinations, average rental prices, offer prices and conversion rates, click behaviour and other information that can be used to improve our customer service and adjust our content and services to the interests of our customers.

You can block collection of this information on the Website by choosing „Block cookies“ when the cookie directive is displayed upon visiting the Website.

10. Use of Google Universal Analytics

This Website uses Google Universal Analytics, a web analysis service from Google Inc. (hereinafter referred to as „Google“). Google uses a so-called cookie, i.e. text file, that is stored on your computer and allowswebsite use by existing and potential customers to be analysed. The information about your use of this Website that is created by the cookie is, as a rule, transferred to a Google server in the US and stored there. If IP anonymisation is activated on this Website, however, Google first shortens IP addresses within the member states of the European Union or other contracting states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the US and shortened there. On behalf of the operator of this Website, Google analyses this information about website use to prepare reports about website activity and provide other services to the website operator concerning website use and Internet use. The IP addresses transferred from the computer browsers of Website users for Google Universal Analytics are not combined with other Google data. 11. Use of Google Maps

The Europcar mobile apps and mobile website, and the reservation and station finder applications on the Website use Google Maps API applications. These applications are absolutely necessary for operation and complete availability of the reservation service. By using the mobile app/website, or the reservation or station finder applications, users declare that they consent to application of the Google Terms of Service and Privacy Policy. The Google Terms of Service can be viewed at http://www.google.de/intl/de/policies/terms/regional.html. The Google Privacy Policy is available at http://www.google.de/intl/de/policies/privacy/. Google Maps is used to display the appropriate area map and nearest Europcar stations. All location data is transferred to Google in anonymous form; no other information is disclosed to Google.

12. Use of collected information and purpose of data processing

The object of the Company is the rental of motor vehicles and leasing of equipment of all kinds, together with associated services. Information is collected, processed and used for this purpose.

We collect and process personal information so that Europcar Group companies, their franchisees, subcontractors and partners can provide contracted services and requested performance in kind.

Europcar can, in particular use the information for:

-    processing a vehicle rental and all associated services (preparing an offer, making an online reservation, modifying or cancelling an existing reservation, sending and managing your invoices, etc.),
-    if an online reservation is begun or not completed, storing the selection and sending it by email to help with making a reservation,
-    sending emails with special offers, provided consent to this effect has been provided,
-    answering questions or suggestions,
-    making visits to our Website more pleasant,
-    sending our email newsletter, provided consent to this effect has been provided,
-    managing contest participation,
-    sending invoices by email, or contacting customers in connection with participation in customer surveys for improving our services, provided consent to this effect has been provided.

Europcar hereby informs you that personal information provided through the Website is stored in the Europcar and Europcar Group customer management systems for managing reserved vehicle rentals, customer relationship management, and further developing and improving the services offered. We only use personal information for advertising purposes to inform you, for example, by email or in other ways about any campaigns and products that could be of interest, and only if you have provided consent to this effect, or this is permitted under applicable law even without consent.

This consent can be withdrawn at any time by sending an email to dataprivacy@europcar.at.


13. Transmission of collected information

We may disclose personal information to Europcar Group companies, their franchisees, subcontractors and partners for the provision of contracted services and requested performance in kind.

Europcar also engages external service providers to provide technical and other support for various applications, such as Q2E GmbH (Daniel Gran-Straße 48, 3100 St. Pölten - www.q2e.at), iProspect GmbH (Gumpendorfer Straße 11-13/19, 1060 Vienna - www.iprospect.at) and Maillog Richter & Weiner GesmbH (Talpagasse 1a, 1230 Vienna - www.maillog.at). Personal information may be accessible to these external service providers and other contractors if required to provide these services.

If personal information must be disclosed to third parties, this is only done after a contract data processing agreement has been concluded with the third party that obligates the third party to use appropriate security measures to protect personal information and prohibits the third party from using this information for its own purposes.

We are authorised to disclose personal information to third parties:

-    if we buy or sell business units or assets. In this case, we can disclose personal information to potential buyers or sellers of these business units or assets.
-    if Europcar or a majority of its assets are taken over by a third party. In this case, the personal information that Europcar has collected about its customers belongs to the assets.
-    if we are obligated to disclose your personal information in order to fulfil a statutory obligation, enforce or implement our terms of service, general rental terms (available at www.europcar.at/avb) and other agreements, or protect the rights, property or security of Europcar, customers or other persons, provided a legitimate interest exists.

14. Europcar partners and links to other websites

We cooperate with leading external service providers to provide a broad range of services. All of the services provided by external partners on our Website are identified as such. Even though Europcar only collaborates with leading external service providers, they may use different privacy policies. Other websites that are not subject to the Europcar Privacy Policy are accessible from various locations on our Website. The Privacy Policy that applies to Europcar websites does not apply when such a website is accessed. We therefore recommend that users of our Website examine the privacy policies of all linked third party websites in order to inform themselves of the applicable procedures for data collection, processing and transmission. Europcar assumes no liability for the contents of third party websites that are accessible by these links, or for the use of these websites.

15. Secure storage of personal information and data security

We want customers and visitors to our Internet website to feel secure when using our Website and reserving vehicles. We therefore make it a top priority to protect the personal information that is collected.

We only store personal information as long as necessary under Austrian law for the purposes described in this Privacy Policy. Europcar and its external partners implement all appropriate technical and organisational security measures necessary to protect personal information from unauthorised or unlawful processing, accidental loss, destruction and damage.

Europcar implements all appropriate technical and organisational security measures to maintain the level of security required for processed personal information and to protect your personal information against unauthorised or unlawful processing, accidental loss, destruction and damage.

We provide a secure online environment. Our systems are configured to use encrypted data, encryption technologies and firewalls that satisfy the industry standard. If personal information is sent over the Internet to our Website, the data is protected using secure socket layer (SSL) technology to ensure secure transmission.

All credit card transactions performed on our Website are performed using our secure server technology.

This involves a number of security functions, including, in particular, the following:

17. Subscribing and unsubscribing to the Europcar email newsletter

The Europcar and Europcar Group email newsletter provides information about current offers, prices, products, services and contests. We only send email newsletters to users who have given their consent to do so (opt-in).

Recipients of the email newsletter may use a link in the newsletter itself or on the Europcar Website to unsubscribe at any time. Unsubscribe requests can be sent in writing at any time by email to dataprivacy@europcar.at or by post to Europcar Austria, ARAC GmbH, Data Protection and Customer Card Department, Brunner Straße 85, A-1230 Vienna.

18. Changes to the privacy policy

Our Privacy Policy is subject to change at any time. We therefore recommend that you examine this policy regularly to inform yourself about our obligations concerning the security and protection of personal information.

Europcar includes a notice on the Website to provide information about all important changes to the Privacy Policy. The date of the last change is shown at the end of the policy.
